Privacy Policy

This is the privacy policy of Binasewer Network Services (“BNS”).  In this Privacy Notice, “we”, “us” and “our” refers to BNS, and “you” and “your” includes third parties whose personal data you have provided to BNS.

1.  Acquiring and Processing of Personal Data (including disclosure)

BNS strongly believes in a consumer’s right to privacy. BNS will only process your personal data in accordance with the Personal Data Protection Act 2010, the applicable regulations, guidelines, orders made under the PDPA and any statutory amendments or re-enactments made of the PDPA from time to time (collectively referred to as the “PDPA”) as well as this Privacy Policy. 

The word “personal data” is as defined in the PDPA.   To facilitate the provision of products and services to you, we may process, use and disclose your personal data to the following classes of third parties:

• (a) any party who is involved in connection with corporate exercises, such as a potential or actual sale/disposal of any business or interest of BNS, merger, consolidation, re-organisation or funding exercise relating to BNS, or asset sale, or in the event of winding-up BNS 
• (b) regulatory authorities and enforcement agencies
• (c) advertising and marketing partners
• (d) payment processors 
• (e) customer support and communication 
• (f)  logistics and shipping partners 
• (g) any court of law or any relevant party in connection with any claim or legal proceedings
• (h) our contractors, service providers, consultants, and advisors on a need-to-know basis. 

BNS also does not process sensitive personal data unless your explicit consent has been obtained and the processing is necessary:-

(a) for the purposes of exercising or performing any right or obligation which is conferred or imposed by the law on you in connection with your employment;
(b) to protect your vital interest or any other person where consent cannot be given on behalf of you or when we cannot reasonably expect to obtain consent;
(c) to protect the vital interests of another person where consent by or on behalf of you has been unreasonably withheld;
(d) for the purpose of, or in connection with any legal proceedings;
(e)     for the purposes of obtaining legal advice;
(f)     for the purposes of establishing, exercising or defending legal rights;
(g)     for the administration of justice;
(h)     for the exercise of any functions conferred on any person by or under any written law;
(i)     or any other purposes as the thought fit by the Government of Malaysia

Please note that “sensitive personal data” is as defined in the PDPA.

2. ​Usage tracking

For the web user to BNS’s website, our web server automatically collects information on your domain type, browser used and your IP address for statistical purposes only, which will be used to improve the content of our web page and not sold to other organizations for any purpose. Since we gather certain types of information about our users, we feel you should fully understand our policy and the terms and conditions on the capture and use of those information.

3. Security

BNS will take all practical steps to protect personal data from any loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction when processing personal data. While every practicable step is taken to protect your personal data, BNS will not be responsible for any loss or damages arising from any loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction caused by third parties or which is beyond our control.

4. Third Party’s Website

Links to our subsidiaries’ websites and other third party websites are provided for your convenience and reference. We advise you to review the privacy policy of these linked websites as the sites might have their own policy in place. We are not responsible for the content on these linked websites.

5. Cookies

With respect to cookies, we do place a text file called a “cookie” in the browser files of your computer. The cookie itself does not contain personal information although it will enable us to relate your use of this site to information that you have specifically and knowingly provided. But the only personal information a cookie can contain is the information you supply yourself. BNS uses cookies to track user traffic patterns and our advertising system delivers a one-time cookie to better track ad impressions and click rates. You can refuse cookies by turning them off in your browser. If you’ve set your browser to warn you before accepting cookies, you will receive the warning message with each cookie. You do not need to have cookies turned on to use this site.

6. Changes in the Privacy Policy

In the event if BNS’s policy on information practices change at some time in the future, we will use only the data collected from the time of our policy change forward.

7. Your Consent

By using this site, you agree and consent to the collection and use of this information by BNS. If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.

8. Your rights

Your rights as a web user are stated in Division 4 of the Personal Data Protection Act 2010. BNS will comply with any request to access, correct, withdraw consent or prevent the processing of personal data in accordance to the PDPA. BNS however, may refuse any such request in circumstances as provided in the PDPA. To make any such request, kindly contact us. You are advised to read the PDPA to determine your rights as a user of this website.

9. Limit The Process Of Your Personal Data

If you:

• do not wish to receive offers, promotions and marketing materials and information on other products and services from us or our partners;
• have further query; or
• would like us to cease processing your personal data for a specified purpose or in a specified manner
